Terms of Service

1. Scope
These Terms of Service apply to all contracts between Mario Greiner (hereinafter "Provider") and the user (hereinafter "Customer") regarding the use of the FoxRide app and related services.
Deviating terms and conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.
2. Subject of Contract
The Provider provides the Customer with the FoxRide app as a bicycle computer application for iOS. The app offers:
- Basic features (free): Workout tracking, GPS recording, Apple Health integration
- Premium modules (paid): Custom dashboards, sensor integration, extended route features, Bike Garage, Ghost Mode
- Pro Bundle: Access to all premium modules
- Web-based route planner at routes.foxride.app
The exact scope of features is determined by the respective product description on the website and in the App Store.
3. Registration and User Account
The creation of a user account is required for using certain features. The Customer is obligated to provide truthful information and keep their login credentials confidential.
The Customer is responsible for all activities that take place under their user account.
If there is suspicion of misuse of the account, the Customer is obligated to inform the Provider immediately.
4. Licenses and Subscriptions
Premium features can be unlocked through monthly or annual subscriptions. Licenses are personal and non-transferable.
When purchasing through the website (web licenses), the Customer receives a license key that can be activated in the app. These licenses are cheaper than App Store purchases because no Apple commission applies.
Subscriptions automatically renew for the respective term unless cancelled before expiration.
Subscription options and pricing: monthly and yearly subscriptions are offered at the current price per period shown in the app and in the App Store. Payment is charged to the Customer's Apple ID account upon confirmation of purchase.
Auto-renewal via the App Store: App Store subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period in the iOS Settings. The renewal cost is charged to the Customer's Apple ID within 24 hours prior to the end of the current period.
Management & cancellation in the App Store: existing App Store subscriptions can be managed, modified, or cancelled at any time under iOS Settings → [Apple ID] → Subscriptions. A cancellation takes effect at the end of the current billing period — already paid periods remain usable.
Refunds: refunds for App Store purchases are handled exclusively by Apple in accordance with Apple's refund policy. FoxRide cannot process direct refunds for App Store purchases. Refund requests must be submitted directly to Apple at reportaproblem.apple.com.
5. Prices and Payment
All prices include statutory VAT (where applicable).
Payment for web licenses is processed through the payment service provider Mollie. Supported methods include credit card, PayPal, Klarna, iDEAL and other local payment methods.
App Store purchases are processed directly through Apple and are subject to Apple's terms.
6. Right of Withdrawal
Consumers have a 14-day right of withdrawal. The right of withdrawal expires for digital content if the Customer has expressly agreed that the Provider may begin performance of the contract and has confirmed that they will lose their right of withdrawal.
Apple's withdrawal terms apply to App Store purchases.
To exercise the right of withdrawal, contact us at [email protected] with a clear statement (e.g. by email) of your decision to withdraw from the contract.
7. Usage Rights and Restrictions
The Customer receives a non-exclusive, non-transferable right to use the app in accordance with these Terms.
The Customer is prohibited from:
- Decompiling, disassembling or reverse engineering the app
- Modifying the app or creating derivative works
- Sharing or selling license keys
- Using the app for illegal purposes
8. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy.
Workout data is primarily stored locally on the user's device. Synchronization with cloud services (e.g. iCloud) is the responsibility of the user.
9. Liability
The Provider has unlimited liability for damages arising from injury to life, body or health as well as for damages caused intentionally or through gross negligence.
For damages caused by slight negligence, the Provider is only liable for breach of essential contractual obligations. Liability is limited to typical, foreseeable damages.
The app serves as training and navigation support. The Provider assumes no liability for accidents, injuries or damages arising from the use of the app while cycling. The user is responsible for their own safety in traffic.
10. Termination
Monthly subscriptions can be cancelled at any time at the end of the current billing period.
Annual subscriptions can be cancelled up to 24 hours before the end of the term.
The right to extraordinary termination for good cause remains unaffected. After termination, already paid periods remain usable.
11. Changes to Terms
The Provider reserves the right to change these Terms. Changes will be communicated to the Customer by email or in the app.
If the Customer does not object within 30 days, the new Terms are considered accepted. This period will be indicated in the change notification.
12. Final Provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent legally permissible, the seat of the Provider.
